Terms of use for DriveGate

These terms of use apply to the DriveGate Internet portal of SEW-EURODRIVE GmbH & Co. KG (SEW) for which registration is mandatory. When users log on to and use the Internet portal, they are accepting these terms of use in their then current version.

Users must register to be able to use the DriveGate Internet portal. Registration authorization and withdrawal of access rights (either partially or fully) is at the discretion of SEW. The user must fill in a registration form to activate DriveGate. The data he or she enters must be complete and correct. SEW then provides the necessary user data.

If users apply for access to customer data for an SEW customer, the SEW customer is notified of the user data. The SEW customer also agrees to these terms and conditions when using the user data. SEW customers can cancel their registrations, register at a later date or be assigned different authorization rights free-of-charge. The customer must notify SEW immediately in writing or by e-mail in case of changes with regards to users with authorization access or the customer data. The customer is aware that other users will have access to the customer data stored in DriveGate, depending on the rights assigned.

The user must ensure that customer and user data is protected against unauthorized access and loss using appropriate security measures. If the customer or user becomes aware, or is suspicious, that third parties are misusing his or her user data, he or she must inform SEW (department CIS-E) in writing or by e-mail and apply for new user data.

DriveGate is a service offered free-of-charge from SEW. SEW provides the customer with important information about its products and services. The content of the DriveGate Internet portal is subject to change at any time without prior notice.

Due to continuous product development, technical inaccuracies or typographic errors, the specifications and conditional details on the products and services offered by SEW in DriveGate are not legally binding.

SEW makes no guarantees that the provision and availability of DriveGate will be uninterrupted or error-free.

The offers contained in DriveGate are not offers in a legal sense, but rather an invitation to the user to submit an inquiry on the products provided. Customer orders may only be placed by an authorized company employee and are legally binding. However, orders are only valid once they have been accepted by SEW and you have received written confirmation from SEW, and, where applicable, with express reference to the application of additional, country-specific contractual conditions for order processing. For details on the legal order information, refer to the order confirmation. The details must be checked by authorized customer employees. Order details, particularly prices, must not be disclosed to third parties.

When information is made available in the DriveGate portal at no cost or when information or software is provided by means of download, SEW does not accept responsibility for the completeness and accuracy of information or software offered on the website, with the exception of deliberate errors in your DriveGate entries.

Any further liability of SEW is excluded, except in cases of

a) willful misconduct,
b) gross negligence on the part of management or senior employees
c) culpable personal injury or death ,
d) fraudulent concealment of a defect
e) breach of fundamental contractual obligations

In case of breach of fundamental contractual obligations, SEW is liable for slight and gross negligence on the part of employees. However, in cases of slight negligence (no willful misconduct or gross negligence), liability is restricted to contract-typical, reasonably foreseeable damage. All further claims are excluded.

SEW cannot guarantee that its websites are virus-free. For his or her own protection, the user must take the required steps to ensure appropriate security and data protection before downloading software.

DriveGate can contain links to the web pages of third parties. SEW accepts no liability for the contents of such web pages, in particular for any direct or indirect damage that results from the use of these external websites. SEW does not make representations about or endorse the content of such websites. Furthermore, SEW does not have any control over the information given therein.

The content of the DriveGate portal is protected by copyright laws. The applicable copyright law must be observed. Access to information on the site does not grant the user the right to use the copyrights, patents or other intellectual property. SEW grants the user a simple, non-exclusive and non-transferable license to download the software and information provided

Data protection
Unless separate consent is granted by the user, personal data will only be collected, processed and used by SEW for the management and use of DriveGate and for SEW marketing purposes. The user agrees to these conditions. Separate consent will be sought for any other data required. For more information on data protection, refer to the section.

Changing the terms of use
The terms of use are subject to change at any time. The version of the terms of use published in DriveGate applies. Use of DriveGate following changes constitutes the user's agreement to such changes.

Final provisions
These terms of use and the entire legal relations created by DriveGate are governed exclusively by German law. Place of execution and place of jurisdiction is the headquarters of SEW in Bruchsal.

If any individual items of these terms and conditions becomes ineffective, this does not affect the contractual force of the remaining conditions.

The English translation of the SEW-EURODRIVE terms and conditions is provided for the convenience of our non-German-speaking custmers. Regardless of this, only the original German-language version is legally binding.
